(September 26, 2017) SEPTEMBER MEETING OF THE COUNTY BOARD Office of the County Auditor/Treasurer of Kandiyohi County, Willmar, Minnesota. The Board of Commissioners of Kandiyohi County met at 10:00 A.M., September 5, 2017, pursuant to adjournment. All members were present. A motion by Nissen 2nd Madsen to approve the payment of claims being $284,358.16 from Revenue Fund, $4,777.70 from Regional Treatment Center Fund, $116,537.49 from Road and Bridge Fund, $30,865.89 from County Building Fund, $24,638.50 from Ditch Fund, $5,826.35 from Library Fund, $3,872.26 from Health & Human Services Building Fund, $17,992.73 from Recorders Technology Fund, $4,460.16 from Eagle Lake Sewer Fund, $39,740.16 from Water & Sewer Fund, $1,896.00 from Water & Sewer Bond Fund, $13,962.38 from Computer/Communications Maintenance Fund, $395.59 from D.A.R.E. Fund, $46,247.05 from Sanitary Landfill Fund according to the detailed listing of claims as recorded in the Office of the County Auditor/Treasurer was on vote unanimously adopted. A motion by Ahmann 2nd Butterfield to approve the minutes from the August 15, 2017 board meeting was on vote unanimously adopted. Bids were opened for SAP 034-598-004, Bridge No. 34J43 Replacement at this time pursuant to published notice as follows: SAP 034-598-004 Bridge No. 34J43 Replacement Bidder Total Amount Bid Estimate: $241,624.00 Duininck, Inc. Prinsburg, MN $256,038.00 Land Pride Construction Paynesville, MN $283,901.80 Landwehr Construction, Inc. St. Cloud, MN $264,528.20 Midwest Contracting, LLC Marshall, MN $287,703.00 Quam Construction Company, Inc. Willmar, MN $235,720.25 Riley Bros Const, Inc. Morris, MN $291,029.50 Jill Bengtson, Executive Director of the Kandiyohi County Housing and Redevelopment Authority (HRA), presented to the Board the 2017 Activities Report and 2018 Tax Levy Request in the amount of $615,000.00. A motion by Madsen 2nd Nissen to approve the 2018 Tax Levy Request from the Kandiyohi County Housing and Redevelopment Authority (HRA) in the amount of $615,000.00 was on vote unanimously adopted. Aaron Backman, Director of the Kandiyohi County and City of Willmar Economic Development Commission (EDC), presented to the Board the proposed 2018 tax levy in the amount of $514,600.00. A motion by Nissen 2nd Madsen to approve the proposed 2018 tax levy for the Kandiyohi County and City of Willmar Economic Development Commission (EDC) in the amount of $514,600.00 was on vote unanimously adopted. Larry Kleindl, County Administrator, appeared and presented the 2018 proposed budget for approval. The report shows proposed revenues of $70,888,600 and proposed expenditures of $70,888,600 with a total tax levy of $32,308.783. A motion by Madsen 2nd Butterfield to approve the 2018 proposed budget and levy as presented was on vote unanimously adopted. Larry Kleindl, County Administrator, spoke to the Board about three purchase requests for the recycling center. Kleindl explained that the granulator, recycling trailer and heaters at the recycling center need to be replaced with an approximately cost of $235,000.00 which would be paid out of fund 65. Jay Baker, Recycling HHW Coordinator, explained in detail regarding the recycling purchase requests. Baker said the first request was for a granulator and explained what the granulator is used for and said that he received three bids for the granulator. The lowest bid was from Sterling Company of New Berlin, WI in the amount of $131,137.00 which did not include wiring or installation bringing the bid to approximately $140,000.00. A motion by Ahmann 2nd Butterfield to approve the purchase of the granulator from Sterling Company of New Berlin, WI in the amount of approximately $140,000.00 was on vote unanimously adopted. The second request was for a new recycling trailer at a cost of $65,000.00. A motion by Madsen 2nd Butterfield to approve the purchase of a new recycling trailer at a cost of $65,000.00 was on vote unanimously adopted. The third request was for new heaters at the recycling center. Baker said that it would be cost efficient to replace all the heaters at this time at a cost of $30,619.00. A motion by Nissen 2nd Madsen to approve the replacement of the heaters at the recycling center at a cost of $30,619.00 was on vote unanimously adopted. Jay Baker, Recycling HHW Coordinator, appeared regarding the installation of a new recycling shed in the City of Blomkest. A motion by Butterfield 2nd Madsen to approve the recycling shed contract between Kandiyohi County and the City of Blomkest for the installation of a new recycling shed in the City of Blomkest as presented was on vote unanimously adopted. A motion by Ahmann 2nd Madsen to approve Resolution 2017-42 was on vote unanimously adopted. RESOLUTION MARKET PRICE FOR THE SOLID WASTE MANAGEMENT TAX Whereas, the solid waste management tax requires political subdivisions to identify by resolution a market price if the political subdivision: a. Subsidizes the cost of service at a facility; or b. Directly bills on a property tax statement for organized collection of mixed municipal solid waste WHEREAS, the political subdivision will be liable for any solid waste management tax based only on the market price amount identified through the resolution. Whereas, the market price is identified in the state statute as the "lowest price available in the area". Whereas, Kandiyohi County has performed research to identify the lowest price available in the area. Therefore, Kandiyohi County declares a market price of $51.23 per ton, based on the lowest price available for collection, transportation, disposal and processing. A motion by Nissen 2nd Ahmann to approve the adoption of the lactation policy as presented was on vote unanimously adopted. A motion by Nissen 2nd Madsen to approve Resolution 2017-43 was on vote unanimously adopted. KANDIYOHI COUNTY RESOLUTION 2017-43 DEPARTMENT OF NATURAL RESOURCES OUTDOOR RECREATION GRANT GAMES LAKE COUNTY PARK DEED RESTRICTIONS WHEREAS, Kandiyohi County was awarded an Outdoor Recreation Grant sponsored through the Minnesota Department of Natural Resources; and WHEREAS, the grant agreement requires Kandiyohi County to record with the deed to all lands within Games Lake County Park specific language; and WHEREAS, in order to comply with the Department of Natural Resources Outdoor Recreation Project Contract OR18-001, certain restrictions will be imposed on the property. NOW THEREFORE, BE IT RESOLVED, by the Kandiyohi County Board of Commissioners, that the following restrictions are hereby imposed on the properties described in Exhibit A: 1. The property shall be permanently managed and maintained for outdoor recreation use. 2. The Grantee shall not at any time convert any portion of the park area to uses other than public outdoor recreation use without the prior written approval of the State acting through its Commissioner of Natural Resources. RESOLUTION WHEREAS, Contract 16002 has in all things been completed, the County Board being fully advised in the premises. NOW THEN, BE IT RESOLVED, that the Board hereby accepts the completed contract for and in behalf of the County of Kandiyohi and authorized final payment to Midwest Contracting, LLC in the amount of $66,207.44. A motion by Ahmann 2nd Butterfield to approve Amendment No. 1 to MN DOT Contract No. 1026221 as presented was on vote unanimously adopted. Mel Odens, Public Works Director, appeared and reported on the bids for SAP 034-598-004 Bridge No. 34J43 Replacement and recommended that the bid be awarded to the lowest bidder, Quam Construction Company, Inc. of Willmar, MN in the amount of $235,720.25. A motion by Madsen 2nd Butterfield to award the bid for SAP 034-598-004 Bridge No. 34J43 Replacement to the lowest bidder, Quam Construction Company, Inc. of Willmar, MN in the amount of $235,720.25 was on vote unanimously adopted. Cory Netland, Wildlife Supervisor for the Department of Natural Resources, appeared on behalf of Pheasants Forever to give the County Board notification of land acquisition of two properties in Kandiyohi County, the Kjeldahl parcel on Lake Wakanda and the Swenson parcel South and West of Atwater.
