Convicted murderer Delbert Huber now in Dept. of Corrections custody

ST. CLOUD -- The 82-year-old rural Paynesville man sentenced to more than 30 years in prison for shooting and killed an Albertville man last fall is now in the custody of the Department of Corrections.

According to the State DOC website, Delbert Huber was admitted to the Minnesota Correctional Facility at St. Cloud on Wednesday. Huber was sentenced Tuesday in Kandiyohi County District Court to 367 months in prison, the maximum allowed sentence for second-degree murder for the Oct. 8, 2011 shooting death of Timothy Richard Larson, 43, in northern Kandiyohi County.

Huber and his son, Timothy John Huber, 46, were both indicted on first-degree murder charges for killing. The elder Huber pleaded guilty to second-degree murder in August. As part of a plea agreement, the first-degree indicting was dismissed.

Timothy Huber's case is still pending, with the attorneys filing briefs to argue omnibus motions, regarding which evidence will be allowed, before the matter will be taken under advisement by District Judge Donald M. Spilseth. Huber faces charges of first- and second-degree murder and faces life in prison on the first-degree charge.
