Convicted murderer Delbert Huber now in DOC custody

ST. CLOUD -- The 82-year-old rural Paynesville man convicted of second-degree murder and sentenced to more than 30 years in prison for shooting an Albertville man to death last fall is now in the custody of the Department of Corrections.

According to the State DOC website, Delbert Huber was admitted Wednesday to the Minnesota Correctional Facility in St. Cloud. Huber was sentenced Tuesday in Kandiyohi County District Court to 367 months in prison, the maximum allowed sentence for second-degree murder, for the Oct. 8, 2011, shooting death of Timothy Richard Larson, 43, in northern Kandiyohi County.

Huber and his son, Timothy John Huber, 46, were both indicted on first-degree murder charges in Larson's death. The elder Huber pleaded guilty to second-degree murder in August. As part of a plea agreement, the first-degree indictment was dismissed.

Timothy Huber's case is still pending, with attorneys filing briefs to argue omnibus motions, regarding which evidence will be allowed, before the matter will be taken under advisement by District Judge Donald M. Spilseth.

Timothy Huber faces charges of first- and second-degree murder and could be sentenced to life in prison on the first-degree charge.
