District Court, Kandiyohi County, Oct. 17

A felony fifth-degree controlled substance charge and misdemeanor charge for possession of a prohibited weapon against Miguel Almarez Valladerez, 30, of Willmar, was dismissed Tuesday by Judge Michael J. Thompson.

In the order, Thompson ruled that Valladerez' consent on June 13 to allow his vehicle to be searched for weapons did not allow officers to expand their search of his vehicle for drugs. A bag of white powdery substance was located in the vehicle by a drug-sniffing canine unit.

Because officers had no basis to expand the scope of the search to controlled substances, Thompson ruled that the alleged controlled substance evidence be suppressed, the charges dismissed and Valladerez' knife returned to him.
