Elder Huber expected in court this morning in Willmar, Minn.

WILLMAR -- Delbert Edwin Huber, 81, the rural Paynesville man indicted on first-degree murder charges, is scheduled for an omnibus hearing this morning before District Judge Michael J. Thompson.

Huber and his son, Timothy John Huber, 45, were indicted by a Kandiyohi County grand jury on Nov. 17 on first-degree premeditated murder charges. They also face second-degree intentional and unintentional murder charges for their roles in the Oct. 8 death of Timothy Richard Larson, 43, of Albertville.

Delbert Huber allegedly shot Larson with a 303 British Enfield rifle during a confrontation over the fact that Larson ordered the Hubers and their farm equipment off farm property owned by Larson's father in rural Belgrade.

As of this morning, Kandiyohi County District Court records show that no certificate of representation -- the notice an attorney files with the court when he or she has been hired to represent a defendant -- had been filed in Huber's case.

Huber has appeared in six court hearings without an attorney and his applications for a public defender have been denied twice by two different judges because Huber owns land.

Huber had repeatedly told the court that his relatives were working on getting money with which to pay an attorney by mortgaging his land. He has been held in the Kandiyohi County Jail on $5 million bail since the shooting.

During an omnibus hearing, a defendant can enter a plea of guilty or not guilty, the attorneys can present evidence in the case and ask the judge for a determination if there is probable cause for the case to go to trial.
