Granite Falls man to serve 23 months for felony domestic assault

GRANITE FALLS -- Marlow Vincent LaBatte Jr., 26, of Granite Falls, will serve 23 months in prison for felony domestic assault.

District Judge Paul Nelson on Friday sentenced LaBatte to serve the prison time and pay a fine and fees of $585. Nelson allowed credit for 60 days served in jail, according to Yellow Medicine County Attorney Keith Helgeson.

LaBatte pleaded guilty to the charge March 22. Under terms of an agreement, a second felony domestic assault charge and a separate charge for second-degree driving while impaired were dismissed.

The charges resulted from an incident that occurred on March 16 outside of Woody's Bar in Wood Lake. The complaint alleges that the defendant assaulted a person outside of the bar, and then continued to harm the individual while in a vehicle and traveling on Minnesota Highway 274.

LaBatte had a blood-alcohol level of 0.23, or nearly three times the legal limit of 0.08, at the time of his arrest, according to the county attorney.

LaBatte has prior convictions for assault and false imprisonment, according to court records.
