Hearing for man in rural Belgrade, Minn., murder case cancelled

WILLMAR -- An omnibus hearing scheduled for Thursday in the first-degree murder case against Timothy John Huber, 45, of rural Paynesville, was cancelled Monday by District Judge Donald M. Spilseth.

No new date was set for the hearing in Kandiyohi County District Court. The court record system listed no reason for the cancellation. However, County Attorney Jenna Fischer had filed a motion for continuance last week, noting that a sheriff's detective whose testimony was required at the hearing is scheduled to be on vacation.

Huber and his father, Delbert Edwin Huber, 82, were both indicted on first-degree murder charges for their roles in the Oct. 8, 2011, shooting death of Timothy Richard Larson at a rural Belgrade residence.

Delbert Huber allegedly shot Larson with a 303 British Enfield rifle during a confrontation over the fact that Larson ordered the Hubers and their farm equipment off Larson's father's farm.

Delbert Huber's next hearing, also an omnibus hearing, is scheduled for Aug. 9. A jury trial in his case is scheduled to begin Sept. 4.

Both Hubers have been in custody at the Kandiyohi County Jail since the incident, with the father held on $5 million bail and the son held on $1 million bail.
