Inmate faces assault charge for breaking another's nose

WILLMAR -- Donald Warren Hayes, 41, an inmate in the Kandiyohi County Jail, made his first court appearance Friday on a third-degree assault charge for allegedly kicking another jail inmate in the face and breaking his nose on Feb. 14.

Hayes, whose address is the Minnesota Correctional Facility at Faribault, is on intensive supervised release, according to information from the state Department of Corrections website. He also faces first- and second-degree murder charges in Redwood County District Court in connection to the September 2008 death of Robert Azure Jr., 13 months, of Redwood Falls. A jury trial is scheduled to begin on April 11 in that case.

His next appearance on the assault charge is March 7 in Kandiyohi County District Court.

According to the complaint, a sheriff's deputy was called to the jail on Feb. 15 regarding an assault between jail inmates on Feb. 14. Surveillance video showed Hayes and the other inmate playing cards at a table, then getting up and going out of camera view before the other man went to the floor and Hayes kicked him in the head, causing a broken nose.

The other inmate said Hayes got upset for no reason. A jailer also witnessed the incident.
