WILLMAR -- A first-degree criminal sexual conduct charge filed in Kandiyohi County District Court against an Aberdeen, S.D., man was dismissed Thursday.


According to a news release from the Kandiyohi County Attorney's office, the charge against Duane David Sukut, 60, was dismissed March 3 as part of negotiations that resulted in Sukut pleading to a first-degree rape charge in Brown County, S.D.

The Kandiyohi County charges, along with charges in both Brown and Walworth counties in South Dakota, were for sexual assault of a 5-year-old girl.

After his plea, Sukut was sentenced to 50 years in prison and will not be eligible for parole from the South Dakota State Penitentiary for 25 years.

He will then be on supervised parole.

He will be required to pay for current and future medical and counseling costs of the victim and will be required to complete psycho-sexual treatment while incarcerated as a condition of his parole.

According to local court records, the charge was filed against Sukut and a warrant issued for his arrest in November.

The dismissal notes that the parents of the child victim supported dismissing the charge so long and Sukut received the South Dakota prison sentence.
