Man faces drug sale charges after large amount of marijuana found in apartment

WILLMAR — A 24-year-old Willmar man made his first court appearance Monday on three felony charges of fifth-degree drug sale and possession for allegedly selling marijuana to a CEE-VI Drug Task Force informant last spring and for the 1.9 pounds of marijuana found Friday in the apartment where he was living.

Nicholas Michael Hurlbut-Voight also faces a gross misdemeanor charge of child neglect and a petty misdemeanor for possession of drug paraphernalia. Unconditional bail was set at $20,000 in each of the two cases against Hurlbut-Voight. His next appearance is Jan. 7 in Kandiyohi County District Court.

According to the first complaint, a CEE-VI informant purchased 17.1 grams of marijuana from Hurlbut-Voight after the informant met the seller on April 26 along 17th Street Northeast. The informant and an agent identified Hurlbut-Voight as the person selling the drugs by his Department of Vehicle Services photo.

The second complaint was filed after Friday, when Willmar police officers went to an apartment along the 2400 block of Fifth Street Southeast in an attempt to arrest Hurlbut-Voight on an outstanding warrant. Hurlbut-Voight met the officers at the door. He allegedly told the officers that there was no marijuana on his person or in the apartment, but the officers reported an overwhelming smell of marijuana coming from the apartment. Hurlbut-Voight was arrested and taken to the county jail.

A woman at the apartment said there was a small child sleeping in the residence, said Hurlbut-Voight had moved in six weeks ago and she gave consent for officers to search the apartment. Officers, along with CEE-VI agents, located a total of 864 grams of marijuana, 8 grams of hashish, multiple pieces of drug paraphernalia, digital scales and more than $1,200 in cash in the apartment. The marijuana was located in multiple bags, in a safe in a bedroom closet and in a bedroom dresser.
