Man gets prison for domestic assault, 12th assault conviction

WILLMAR -- Rogelio Esquivel Torres, 24, of Willmar, was sentenced Wednesday to 23 months in prison and a $50 fine on a felony domestic assault charge for assaulting a woman in May.

As part of a plea agreement reached earlier in Kandiyohi County District Court, Torres received the lowest sentence allowed by state guidelines based on his criminal history score. He was given credit for 209 days already served.

According to the complaint, Torres had 11 prior convictions for assault, including a 2009 conviction on a fourth-degree assault of a peace officer charge for assaulting a Willmar police officer attempting to arrest him.

His other convictions include a November 2011 conviction for a gross misdemeanor fifth-degree assault, a felony for violating an order for protection in August 2008 in Stearns County, plus multiple domestic assault convictions.

The most recent charge was filed after March 15 when Willmar police officers were dispatched to a domestic incident around 6 a.m. to a residence in the southwest quadrant of the city.

A woman there reported that Torres had taken her car without her permission and was upset that she had called law enforcement to report the incident. She said that he argued with her all night and had punched her and threw her into a wall. She said she had to kick him away to complete the phone call to police.

While the woman was talking with an officer, she received 17 phone calls and two texts from Torres, who was located at another southwest Willmar residence and was arrested.
