District Court

Kandiyohi County

n Two felony property damage and two misdemeanor assault charges against Crystal Ruth Gomez, 24, of LeCenter and formerly of Willmar, were continued for dismissal Thursday.

As part of a plea agreement, the charges against Gomez will be dismissed if she successfully completes nine months of probation and testifies against another defendant charged in the case.

Gomez was one of three siblings charged for their roles in assaulting a man and causing more than $3,000 in damage to his vehicle in September.

Ernestina Gomez, 31, also faces two felony property damage charges, plus two misdemeanors for fifth-degree and domestic assault. Her next hearing is July 18.

Marc Anthony Gomez, 34, of Willmar, was sentenced in February to 365 days in jail, with 358 days stayed, a total of $4,000 in fines, of which $3,450 was stayed, and two years of probation on an amended charge of gross misdemeanor property damage and a misdemeanor charge of fifth-degree assault.

According to the complaints against the trio, Willmar police were called around 11:20 p.m. Sept. 15 to El Tapatio restaurant along First Street South. A man there said that Marc Gomez assaulted him in a restroom and then all three of the siblings followed him to a vehicle in the parking lot where they continued to assault him and damage his vehicle. The man reported that the attack was unprovoked. He went to Rice Memorial Hospital for treatment of his injuries.

The officers found that the body of his vehicle was dented and the paint was scraped. The estimate to fix the damage to the vehicle was $3,128.14.

Two days later, the man gave a further statement to police, including that Marc Gomez hit him in the restaurant, but that all three participated in the assault and vehicle damage in the parking lot. Police contacted all three of the siblings, who gave various statements admitting or denying that they were at the restaurant or that there was an altercation that evening.

Two witnesses told officers that they were with the man at the restaurant to watch a boxing match. They said they saw Marc Gomez assault the man while his sisters and another man stood by the restroom door. They broke up the assault, told employees to call the police and went outside to a vehicle with the man. They said that Marc Gomez opened the front door of the vehicle and continued to punch the man while Ernestina Gomez got into the back seat of the vehicle and hit the man from behind. One of the men called law enforcement on his cell phone and then the Gomez siblings left.
