- Juanel Anthony Mikulak, 22, of Alexandria and currently in the county jail, pleaded guilty Monday to three felony charges of domestic assault and violation of a harassment restraining order. He will be sentenced Dec. 28.
Under a plea agreement, another felony for violating a harassment restraining order and a gross misdemeanor for domestic assault will be dismissed.
The domestic assault charge was filed after Willmar police were called to an apartment along Lakeland Drive Southeast around 9 p.m. Sept 21. A woman there said she had been assaulted by Mikulak after they had argued and she told him to leave. She said he prevented her from calling for help on a landline phone by breaking it and a cell phone by taking it away from her.
The HRO violation charges were filed after a woman reported to Willmar police on Aug. 10 that her daughter, now 17, was with Mikulak at Rice Hospital a few days before. The woman had a restraining order against Mikulak on behalf of the girl. Surveillance video from the hospital confirmed that a man matching Mikulak's appearance was in the lobby with the girl.
The girl was interviewed and admitted to spending the entire day with Mikulak and going with him to the hospital to have a medical concern addressed. The girl also reported she had two voicemail messages recorded on her cell phone from Mikulak.
Mikulak has prior convictions including a fifth-degree assault charge in June 2006, another fifth degree in July 2006, a gross misdemeanor assault conviction in October 2006 and a felony assault conviction in October 2007. All the convictions were in Renville County.
- Kristi L. Giese, 29, of Willmar, was sentenced Monday to 30 days in the county jail, a $500 fine and five years of probation on a felony charge of storing methamphetamine paraphernalia in the presence of children.
Her jail sentence, set for Nov. 26, 2010, can be deferred if she is in compliance with probation requirements, including attending treatment and aftercare, following the recommendations and attending a 12-step program. Giese received a stay of adjudication on her sentence, under which no conviction will appear if she complies with the court's conditions.
Under a plea agreement, a gross misdemeanor charge of child endangerment and a petty misdemeanor for possession of drug paraphernalia were dismissed.
The charges were filed after CEE-VI Drug Task Force agents executed a search warrant on Giese's home on Feb. 13. They found Giese, another woman and three small children, ages 3 and 1, in the home. Giese admitted to using meth that day and marijuana two days prior while the three children were there. Several drug pipes and other drug paraphernalia were located in the home during the search.
