- Guillermo Soto Bernal, 22, of Willmar, was sentenced Friday to one year and one day in prison, which was stayed, five years of probation, 40 days in jail and a $50 fine on a felony charge of aggravated forgery for using another man's identity to work.

Bernal was also ordered to cooperate with agents from the federal Bureau of Immigration and Customs Enforcement and obey all immigration laws.

As part of a plea agreement, a felony charge of forgery was dismissed.

The charges were filed after Willmar police were dispatched around 12:45 a.m. March 16, 2008, on an assault case. A woman reported that Bernal, from whom she was separated, was involved in a fight. She said he used the name of Joey Rubalcada to work.

Bernal was questioned by the officer and produced a Mexican driver's license as identification. He refused to answer when questioned about working under another name.

The investigation showed that someone had applied for a state identification card in the Rubalcada name in October 2007 using a Texas ID card and birth certificate and a Social Security card. Police also gathered employment documents from Jennie-O Turkey Store signed in the Rubalcada name. The documents were supported by a Minnesota ID card, the one issued in October 2007, and the Social Security card.

The officer identified the ID card photo of Rubalcada as the person who had been identified by the Mexican driver's license as Bernal.

The investigation tracked the stolen identity to Texas, where a man named Joey Rubalcada, with the same date of birth and Social Security number, is incarcerated.

- Raul Alberto Deras-Melgar, 33, of Willmar, made his first appearance Friday on a felony aggravated forgery charge for allegedly forging another man's name to get a driver's license.

Unconditional bail was set at $20,000 with conditional bail at $5,000. His next appearance is Feb. 22.

According to the complaint, from October 2010 to this month, investigators from the Kandiyohi County Sheriff's Office and family services were investigating welfare fraud by Isabel Ruiz-Deras, who married Deras-Melgar without notifying family services. The investigation also revealed that Deras-Melgar applied for a driver's license as Juan Vazquez Monserrate in 2006.

A Housing and Revelopment Authority official identified Deras-Melgar as the person living with Ruiz-Deras and as the father of her children.

Employment records showed that Deras-Melgar had worked for several area companies, including Jennie-O Turkey Store, from 2002 to 2007. A photo on a Jennie-O identification card matched the photo on the driver's license photo on file with the Department of Vehicle Services.

Deras-Melgar was arrested after a traffic stop on Thursday. He allegedly gave officers a Honduran identification card in his real name, which also matched the DVS photo. He also allegedly admitted to using the name since 2002, marrying Ruiz-Melgar, fathering her children, working at Jennie-O and the Southern Minnesota Beet Sugar Cooperative and to being convicted of driving while impaired under the false name four to five years ago.
