Maple Lake man held for stalking Dassel woman

LITCHFIELD -- Joel Samuel Silva, 32, of rural Maple Lake, is in the Meeker County Jail, held on $40,000 unconditional bail, pending future court hearings.

He is charged with felony stalking for allegedly making harassing phone calls and sending an explicit sexual photo to a rural Dassel woman.

According to a news release from Meeker County Sheriff Jeff Norlin, Silva was also arrested Wednesday on charges of drug and marijuana possession.

The series of incidents began in February 2010 with harassing phone calls that, over time, escalated to heavy breathing and finally, the explicit photo.

The investigation revealed that the cell phone used in the calls was purchased at Wal-Mart in Buffalo. A photograph of the unknown purchaser was obtained and later identified by area law enforcement as Silva.

Silva was unknown to the victim and has a criminal conviction history of past harassment, stalking, and obscene phone calls dating back to 2003 in Wright, Ramsey and Douglas counties in Minnesota.

District Court

Kandiyohi County

- Wilfredo Herrera-Discia, 36, of Willmar was sentenced Friday to one year and one day in prison, which was stayed, five years of probation, a $50 fine and 86 days in the county jail on a felony charge of aggravated forgery for using another person's identification to work.

He was given credit for 86 days already served and ordered to cooperate with agents from the Bureau of Immigration and Customs Enforcement.

As part of a plea agreement, two charges of forgery and aggravated forgery were dismissed. He was sentenced on a misdemeanor charge of driving without a license.

He is also known as Jose Belaez-Dones and Jose Luis Velez Dones.

According to the complaint, on Dec. 22, 2008, a Willmar police officer on routine patrol came upon a vehicle with a brake light out. The officer stopped the vehicle and the driver said he didn't have a driver's license but gave the Jose Belaez-Dones name. He also said he didn't have insurance on the car. The officer ran his name through the state's system, but the name was not valid.

The man was arrested and, at the Law Enforcement Center, his fingerprints were run through the Interagency Border Inspection System database, which identified the man as Herrera-Discia. When questioned, the man said he was Jose Luis Velez Dones, but then admitted his name was Herrera-Discia.

The investigation into the man's identities included employment documents from Jennie-O Turkey Store signed in the false name, along with an employee photo that matched his booking photo and copies of a Minnesota ID card and Social Security number.
