District Court

Kandiyohi County

- Juan Carlos Patino, 32, of Willmar, was sentenced Monday to 365 days in jail, with 180 days to serve and 185 days stayed, a year of probation and a $50 fine on a gross misdemeanor charge of assault.

The charge reduced from a felony for third-degree assault. It was filed after Willmar police officers were called around 2:50 a.m. Dec. 18 to Regency Estates West on a report of an assault. The caller reported that a man had been hit in the head with a bottle and was bleeding. Officers arrived to find blood on the exterior and interior of a home and on items of clothing. They found a man who was unsteady on his feet, covered in blood and bleeding profusely from his head.

A woman, who was also covered in blood, said several people, including Patino, had been drinking at the home earlier in the evening. She said Patino and the victim argued inside the home and then took a fight outside. She said she had seen Patino get an object from his vehicle, hit the man and then smash a bottle over his head. The complaint does not elaborate as to what the initial object was.

The man's injuries included three 1-inch gashes on the top and right side of his head and a 6- to 7-inch gash from his chest into his armpit. He also had two smaller wounds on his ribcage.

- Gregory Patrick Foster, 44, of New London, made his first appearance Monday on two second-degree criminal sexual conduct charges for allegedly sexually assaulting two girls when they were 10 and 12 years old.

Unconditional bail was set at $60,000 with conditional bail at $50,000. His next appearance is April 11.

According to the complaint, a now 19-year-old girl reported in July 2008 to Lonsdale Police that she'd been sexually assaulted twice by Foster, when she was 10 and 12 years old, while they lived in a rural New London home. She said the first incident included Foster sexually touching her buttocks and the second incident included him touching her breasts and vaginal area.

Two other children and a woman also provided information about the second incident that indicated that Foster had touched the girl in a sexual manner. One of the children, now 18, reported that Foster had also touched her in a sexual manner in 2008 and also asked her if she wanted to see videotapes of her mother having sex. The child refused.
