District Court

Kandiyohi County

WILLMAR — Carlos Enrique Padilla, 29, of Willmar, was sentenced Friday to five years of supervised probation for felony check forgery and 118 days in jail, with credit for 118 days already served.

He was also sentenced to 90 days for misdemeanor domestic assault and given credit for 90 days already served.

Padilla entered an Alford plea in July to the misdemeanor charge of domestic assault and pleaded guilty to felony check forgery. By entering an Alford plea to the misdemeanor assault charge, Padilla did not admit the act, but agreed that there was enough evidence to convict. It was recorded as a guilty plea.

As part of a plea agreement in July, a total of 29 felony charges against Padilla, including domestic assault by strangulation, check forgery, aggravated forgery and perjury, were dismissed.

In exchange for the pleas, 27 felonies related to a 2008 forgery and perjury criminal case were dismissed and a felony assault and misdemeanor charge of giving a police officer a false name that were related to an April domestic assault case were dismissed.

In the assault case, a woman told police that Padilla, who is also known as Fredis Lopez Gerrero, had assaulted her. The woman said Padilla had kicked and choked her because she was “disrespecting” him and had talked with another man.

Padilla denied assaulting the woman.

During the investigation of the assault charge, Padilla gave officers the Gerrero name, which showed he had a warrant for his arrest in the 2008 case, for allegedly signing multiple family services documents, federal tax documents, employment documents and checks in the false name.

WILLMAR — Kristi Louise Giese, 34, of Willmar, was sentenced to one year in prison on a charge of felony fifth-degree drug possession but the sentence was stayed for 10 years.

Giese was sentenced to 10 years of probation, with conditions including completing chemical assessments, chemical dependency evaluations, attending counseling, not using alcohol or drugs and submitting to random testing.

She was also sentenced to serve 180 days in Kandiyohi County Jail with credit for 40 days served. She is required to report to jail in October and November to serve 60 days and may begin 60 days of house arrest in December.

The judge’s comment noted that house arrest was given as an option because Giese would better respond to positive reinforcement and has made progress in rehabilitation.

If Giese is not compliant with her probation, she will be required to serve the entire remaining sentence in jail.

According to court documents, CEE-VI Drug Task Force agents and other law enforcement officers served a warrant on a home on June 5 in northwest Willmar where they located packages of methamphetamine and morphine and drug paraphernalia.

They found Giese, 47-year-old Franciso Eliserio, and a 15-year-old girl at the home.

Giese and Eliserio both originally faced three felony charges of drug possession and storing meth paraphernalia in the presence of a child.

Both pleaded guilty to one charge of felony fifth-degree drug possession in July.
