SPICER — The Kandiyohi County Sheriff’s Office is investigating a credit card fraud reported Thursday by a Spicer resident. The individual’s credit card number was used to place an order on the Internet.

John Ruben Garcia, 25, of Willmar made his first appearance Thursday morning on two counts of second-degree assault and two counts of terroristic threats, all felonies. Judge Michael J. Thompson signed an order that Garcia continue to be held in the Kandiyohi County Jail pending further proceedings.

The criminal complaint alleges Garcia assaulted two men with an AR-15 rifle and threatened violence against the men early Tuesday morning at a residence in the 1700 block of Eighth Avenue Southeast in Willmar.

The complaint alleges Garcia entered the home shortly before 3 a.m., and asked one of the men in the house where the keys were to a car that was owned by Garcia’s father and which had been stolen. The man said he did not know Garcia and said he did not know what Garcia was talking about, at which time Garcia allegedly pointed the rifle at the man.

The man said his brother entered the house, followed by Garcia’s father, who also asked where the keys were. The man’s brother pushed Garcia outside and went to get the phone. Officers then arrived and arrested Garcia.
