Theft

SPICER — A Spicer resident reported Tuesday that a home safe had been emptied of its contents, including gold and silver coins. The theft, which happened at a home on Decathelon Drive, is under investigation by the Kandiyohi County Sheriff’s Office.

As part of a plea agreement, a total of 29 felony charges were dismissed Tuesday against a Willmar man who had been accused of domestic assault by strangulation, check forgery, aggravated forgery and perjury for signing documents in a false name.

Carlos Enrique Padilla, 30, of Willmar, entered an Alford plea to a misdemeanor charge of domestic assault and pleaded guilty to one felony charge of check forgery.

In exchange for the pleas, 27 felonies related to a 2008 forgery and perjury criminal case were dismissed and a felony assault and misdemeanor charge of giving a police officer a false name that were related to an April domestic assault case were dismissed.

Sentencing is set for Sept. 8.

In the assault case, a woman told police that Padilla, who is also known as Fredis Lopez Gerrero, had assaulted her. The woman said Padilla had kicked and choked her because she was “disrespecting” him and had talked with another man.

Padilla denied assaulting the woman.

By entering an Alford plea to the misdemeanor assault charge, Padilla does not admit the act, but agrees that there is enough evidence to convict. It is recorded as a guilty plea.

During the investigation of the assault charge, Padilla gave officers the Gerrero name, which showed he had a warrant for his arrest in the 2008 case, for allegedly signing multiple family services documents, federal tax documents, employment documents and checks in the false name.
