Two Wahpeton men held in Wednesday's drive-by shooting

A man arrested in connection with a drive-by shooting in Wahpeton, N.D., Wednesday night was released from prison five months ago after serving time for a 2006 stabbing.

Authorities arrested Andrew Lopez and his roommate, Crystal Garcia, shortly after a man in a vehicle fired several shots from a handgun toward a residence at 905 Harrison Road just before 9 p.m. Wednesday.

A woman and eight children were in the home and yard, but authorities say no one was hurt. Police say they have not determined a possible motive.

Lopez, 28, was charged Thursday with Class C felony reckless endangerment in Richland County District Court in connection with the Wednesday night incident. Garcia, 28, is charged with Class C felony accomplice to reckless endangerment.

The Wahpeton pair were arrested Wednesday night in neighboring Breckenridge, Minn., after police stopped the suspected vehicle that Garcia was driving. Lopez was her passenger, Breckenridge Police Chief Steve Rensvold said.

Authorities recovered a .22-caliber handgun inside the vehicle, believed to have been used in the shooting, Rensvold said.

Lopez was released from prison on Feb. 1, according to the North Dakota State Penitentiary. He received a three-year sentence in 2006 after pleading guilty to two charges of aggravated assault with a dangerous weapon, according to court records and Forum archives. Lopez was initially charged with attempted murder in connection with the April 11, 2006, stabbing of two men in Wahpeton.

On Thursday, Lopez and Garcia waived extradition from Minnesota and were transferred to Richland County.

A court date for the pair has not yet been set.
