Willmar man pleads to misdemeanor in domestic case, felony dismissed

WILLMAR -- Brian Joseph Cash, 48, of Willmar, pleaded guilty Thursday to a misdemeanor charge of domestic assault.

As part of a plea agreement reached in Kandiyohi County District Court, a felony third-degree assault charge will be dismissed. He will be sentenced July 7.

The charges were filed after two Willmar police officers were dispatched to an altercation around 11 p.m. April 23 along the 1600 block of Fifth Street Southwest.

The caller reported a man and woman were arguing outside a vehicle. The caller said the man hit the woman and forced her into the vehicle. He then drove away. The caller described the vehicle and the man to the police.

Officers located the vehicle nearby. The man, identified as Cash, was subsequently arrested.

The woman was taken to Rice Memorial Hospital in Willmar for treatment of a lip injury.

She told officers she and Cash had gone out that evening, and that she had told him she did not want to stay at home with him and attempted to leave. She said Cash prevented her from getting in the vehicle and struck her in the face.

She said she walked away and that Cash followed her in the vehicle. The woman said she got into the vehicle when he told her he would take her to the hospital. However, when he did not drive to the hospital, she said she exited the vehicle, at which point the officers arrived.

When interviewed, Cash told officers he and the woman had gone out for drinks at two establishments earlier in the night. He admitted to hitting the woman, but claimed it was in self-defense.
