Willmar man sentenced to probation, jail for scheme to prevent arrest of his brother

WILLMAR -- Erik Ozornia, 22, of Willmar, was sentenced Monday to 30 days in jail, three years of probation and a $1,000 fine on a felony charge of aiding an offender.

He was charged with attempting to prevent his brother's arrest in April.

Ozornia was also ordered to obtain and maintain employment and be a law-abiding citizen. As part of a plea agreement, three additional charges were dismissed.

He was given credit for 25 days already served in jail.

Ozornia was one of three people charged following an April 7 incident.

Jessica Marie Lozano was also sentenced Monday on a gross misdemeanor for aiding an offender for her role in the incident. She will serve three days in jail, three years of probation and must pay a $1,000 fine.

Darcy Lou Maxine Holwerda, 21, of Willmar, was sentenced in August to 45 days in jail for her the incident. She must pay a $1,000 fine and serve three years of probation.

Ozornia's brother, Emilio, whom officers were attempting to arrest, faces a first-degree drug sale charge for allegedly selling 17.5 grams of methamphetamine to a CEE-VI Drug Task Force informant in January.

His next court appearance is Sept. 27 with a jury trial scheduled for Sept. 27 and 28. The charges were filed after CEE-VI agents went to a rural Willmar home around 1:15 p.m. April 7 to apprehend Emilio Ozornia. Holwerda told the officers repeatedly the Ozornia was not there. She left the residence, but was advised by officers she could be charged if Ozornia was found him in the home. She again denied that he was there.

Officers continued their surveillance of the home. While there, they received a call from dispatch of a large fight at Regency Estates West.

Other officers responded to the location, where the call was determined to be a hoax.

The officers traced hoax call to Lozano's phone and called the number. Lozano answered the phone and handed it over to Erik Ozornia when she learned the nature of the call. Ozornia said he had witnessed his brother in the trailer park and wanted him picked up for his own good, as he was high on drugs.

A search warrant was served on the home, and Emilio Ozornia was arrested.
