Atwater man gets probation, treatment orders for March assault

WILLMAR — Cody James Michael Hinman, 22, of Atwater, was sentenced Wednesday to seven years of probation, 73 days in jail, a $50 fine and 60 hours of community service on a felony charge of second-degree assault for pointing a shotgun at a woman in March.

As part of his sentence handed down by District Judge Randall Slieter in Kandiyohi County District Court, Hinman was also ordered to attend treatment, to follow the recommendations of a domestic abuse evaluation, to attend a 12-step sobriety program and submit to 30 days of electronic alcohol monitoring for each year while on probation. He was ordered not to use alcohol or drugs and not to possess weapons or firearms.

He was also ordered to serve 90 days in jail on a misdemeanor charge of domestic assault for another incident involving the same woman. He was given credit for 73 days already served.

Two additional felony charges of assault and terroristic threats, plus another misdemeanor charge of domestic assault, were dismissed.

The first set of charges was filed after March 28, when Kandiyohi County sheriff's deputies were called to an address along the 20000 block of U.S. Highway 12 Northeast in rural Atwater. The woman reported that Hinman was intoxicated and upset, taking a 12-gauge Benelli shotgun under his chin, in front of the woman. He then swung the butt of the gun toward the woman but missed her. He then turned the gun on her and told her the weapon was loaded and said he was going to shoot her.

The second set of charges was filed soon after the March 28 incident, stemming from an incident that happened earlier at the same residence. While investigating the other incident, deputies learned that Hinman had injured the woman in another violent tirade 10 days earlier.
