Attempted murder suspect arrested in Benson

BENSON -- A 29-year-old man living in Benson was arrested Monday night after Benson Police were informed that he was wanted for attempted murder in North Carolina.

According to Benson Police Chief Jim Crace, Marlon DeWayne Garland was arrested without incident and is in the Swift County Jail. The man, also known as Marlon Garlin, has a long criminal history including arrests for narcotics and resisting arrest.

Earlier on Monday, local police were informed by North Carolina authorities that the weapon used in the shooting had not been recovered and that Garland should be considered armed and dangerous. The Benson PD obtained search warrants for two city residences, where Garland was known to be living or staying.

The first warrant was served around 9:30 p.m. at 307 15th St. N. The suspect was not located at the residence; however, another man was arrested on a North Carolina warrant for con-trolled substance. Thomas L. Mahatha Jr., 20, was booked into the county jail and is awaiting a decision by North Carolina authorities on whether they will extradite him.

While searching that residence, an officer who was performing surveillance observed a man who resembled Garland leave the other residence. Other officers responded to the scene and arrested Garland without incident as he was walking down the street.

The second search warrant was executed at 10:50 P.M. at 945 Kansas Ave. with the intent of recovering the weapon that had been used in the North Carolina incident.

The Benson Police Department was assisted by the Swift County Sheriff's office, Appleton Police Department, and Minnesota State Patrol.
