Rural Granite Falls, Minn., man to serve 48 months for sex with a minor

GRANITE FALLS — Jonathan David Gardner, 30, of rural Granite Falls, was sentenced to 48 months in prison on a charge of third-degree criminal sexual conduct involving a minor.

District Judge Thomas Van Hon sentenced Gardner on Wednesday to serve the prison time, pay $585 in fines, fees and restitution, and to register as a predatory offender. He is expected to serve the time at the Minnesota Correctional Facility in St. Cloud, according to information from the Yellow Medicine County

Attorney’s Office.

Gardner pleaded guilty Jan. 17. In return for the plea, charges of first- and second-degree criminal sexual conduct were dismissed.

The criminal complaint alleges Gardner used his position of authority over youth as a tobacco cessation worker with the Upper Sioux Community to engage in sexual activities with a girl at his home. He was 29 years old and the victim was 11 when the incidents occurred.

A tribal officer forwarded allegations of inappropriate conduct by Gardner to the Upper Sioux police chief.
