ATV driver charged

OLIVIA — The driver of an all-terrain vehicle is facing charges in Renville County after a sheriff’s deputy allegedly saw him Thursday night go through an intersection in downtown Morton without stopping and nearly striking two vehicles while he was transporting a passenger.

The Renville County Attorney’s Office filed a felony, first-degree charge of driving while impaired and a gross misdemeanor charge of driving after cancellation Friday against Marcus Douglas Pendleton, 27, in District Court in Renville County.

According to the complaint, a sheriff’s deputy was managing traffic control following a fireworks demonstration at 10:42 p.m. when he observed the ATV driven by the defendant go through the intersection at Main Street and Second Street and proceed south between two vehicles.

The officer recognized the individual and knew his driver’s license was cancelled. After directing traffic, he spoke to the defendant. The defendant submitted to a test and allegedly had a 0.163 percent alcohol level, or twice the legal limit, according to the complaint.

The defendant has a history of traffic offenses, including convictions for driving after cancellation, driving while impaired and fleeing a peace officer.
