District Court

Kandiyohi County

- Luis Ariel Hernandez, 31, of Willmar, was sentenced Tuesday to three days in jail, a $4,500 fine and five years of probation on a felony charge of possessing a machine gun or short-barreled shotgun for a illegally modified shotgun found during a January search of a Regency West home.

Hernandez was also ordered to follow the recommendations of a chemical use assessment, pay $400 in restitution and not use or possess drugs or alcohol.

As part of a plea agreement, another felony charge of receiving stolen property, plus a gross misdemeanor for possessing a pistol or assault weapon as a user of controlled substance and two petty misdemeanor charges of marijuana and drug paraphernalia possession, were dismissed.

Hernandez and Cristian Vergana-Arellano, 19, of Willmar, were charged in the case, along with Paul Avery Leal, 18, of Willmar. Vergana-Arellano was sentenced in April to 18 months in prison, which was stayed, 20 years of probation, a $2,000 fine and 77 days in jail on a felony charge of receiving stolen property.

Leal received a juvenile sentence of six months of probation and 40 hours of community service on a felony charge of receiving stolen property. Felony charges against 16- and 17-year-olds are public record.

According to the complaints against the adults, two guns, including a Remington 870 Express 20-gauge shotgun and a Marlin Model 200 single shot shotgun were located in the home. The Remington shotgun was identified as one the items taken in a Jan. 11 burglary reported in the county. The Marlin had both its barrel and stock shortened, with the barrel measuring 13 inches.

Officers also located knives and rings, which were also discovered to be stolen property, along with drug paraphernalia and 26 grams of marijuana, a stolen iPhone, marijuana growing equipment and shotgun shells in the house.
