Charges against Spicer man are dismissed due to new evidence

WILLMAR — Charges have been dismissed against a Spicer man accused this past May of sexually assaulting a woman.

David H. Kennedy, 24, had faced one count of criminal sexual conduct in the first degree and one count of false imprisonment.

In a statement dated June 19 and filed with the District Court in the Eighth Judicial District, the Kandiyohi County Attorney’s Office said it was dismissing all charges.

According to the statement from the county attorney’s office, new evidence had “come to light demonstrating a lack of probable cause that the defendant committed this charged crime.”

The county attorney’s office specifically cited a statement, given by the alleged victim to local law enforcement, that no sexual assault or attempt to hold the victim against her will took place and that the bruises on her legs were not caused by Kennedy.
