Man faces sex charge for allegedly assaulting girl in tent

WILLMAR -- A 24-year-old Paynesville man made his first court appearance Monday on a third-degree criminal sexual conduct charge for allegedly sexually assaulting a juvenile female in June.

Unconditional bail was set at $125,000 for Timothy George Powers Jr. His next appearance in Kandiyohi County District Court is Aug. 2.

According to the complaint, the Kandiyohi County Sheriff's Office began investigating a sexual assault after receiving a family services report on July 1. A 17-year-old girl said she'd been forced to have sex with Powers. The incident allegedly happened on June 5 near Hawick.

The girl said that she and Powers were discussing religion, while a woman and a child were asleep in the same tent. She said Powers touched her and then forced sexual intercourse with her. The girl said that she didn't want the sexual contact to happen and that she didn't tell anyone until telling a counselor in late June.

A detective met with Powers, who initially denied the sexual contact, but then admitted and said that the girl wanted him to touch her and that she took his hand and moved it to her body. He believed the encounter lasted 10 minutes.

His criminal history involves a juvenile adjudication in March 2001 on first-degree criminal sexual conduct, involving the same girl. He also has felony convictions for assault in January 2009 and September 2007 in Stearns County and a felony conviction for failure to register as a predatory offender in March 2006 in Kandiyohi County.
