Sex offender from Paynesville pleads guilty; sentencing set
WILLMAR -- A sex offender has pleaded guilty to third-degree criminal sexual conduct in exchange for being sentenced according to state guidelines.
The plea agreement with Timothy George Powers Jr., 25, of Paynesville was filed Monday in Kandiyohi County District Court.
Sentencing is scheduled for March 31. Under the agreement, Powers likely will face 70 months, or just under six years, in prison.
He was accused of having nonconsensual sex with a teenaged girl while they were together in a tent at a family gathering. A 6-year-old girl also was present in the tent.
The incident came to light when the teen reported it to Kandiyohi County Family Services in late June 2010, about a month after it happened, and Powers was subsequently arrested.
Powers has a criminal record going back to 2001, when he was adjudicated delinquent for criminal sexual conduct. He was a juvenile at the time. He also was convicted in Kandiyohi County for failing to register as a predatory offender, and has three additional convictions from Stearns County -- two for felony assault and one for misdemeanor domestic assault.
In the plea agreement filed Monday, he stated he has been through multiple residential treatment programs for mental illness and needs to get back on track with his medication.
