MAY MEETING OF THE COUNTY BOARD Office of the County Auditor/Treasurer of Kandiyohi County, Willmar, Minnesota. The Board of Commissioners of Kandiyohi County met at 10:00 A.M., May 6, 2014, pursuant to adjournment. All members were present. A motion by Shuck 2nd Reese to approve the minutes of the April 15, 2014 board meeting was on vote unanimously adopted. A motion by Madsen 2nd Imdieke to approve the payment of claims being $194,471.61 from Revenue Fund, $7,738.53 from Regional Treatment Center, $106,869.83 from Road and Bridge Fund, $75,879.75 from County Building Fund, $5,011.43 from Ditch Fund, $340.92 from Library Fund, $7,251.72 from Health & Human Services Building Fund, $10,324.33 from Recorder's Technology Fund, $230.70 from Eagle Lake Sewer Fund, $24,877.27 from Water & Sewer Fund, $642.98 from Computer/Communication Maintenance Fund, $37,853.69 from Sanitary Landfill Fund, $92.00 from Forfeited Tax Sale Fund according to the detailed listing of claims as recorded in the Office of the County Auditor/Treasurer was on vote unanimously adopted. A motion by Imdieke 2nd Shuck to approve the minutes of the April 28, 2014 Road and Bridge meeting was on vote unanimously adopted. Bids for the 2014 C & D Final Cover Construction at the Kandiyohi County Sanitary Landfill LFDCAP-14 were opened at this time pursuant to published notice as follows: 2014 C & D FINAL COVER CONSTRUCTION AT KANDIYOHI COUNTY SANITARY LANDFILL LFDCAP-14 Bidder Total Amount Bid Engineer's Estimate: $255,767.00 Duininck Inc. Prinsburg, MN $234,763.37 Swenson & Sons Construction New London, MN $164,921.02 A motion by Madsen 2nd Reese to approve the following Resolution was on vote unanimously adopted. RESOLUTION WHEREAS, Contract 13006 for Project SAP 34-607-22, Bridge Replacement: CSAH 7 has in all things been completed, the County Board being fully advised in the premises. NOW THEN, BE IT RESOLVED, that the Board hereby accepts the completed contract for and in behalf of the County of Kandiyohi and authorized final payment to Reiner Contracting, Inc. of Hutchinson, MN in the amount of $14,997.98. ATTEST: BY THE BOARD: Mark Thompson Jim Butterfield County Auditor/Treasurer Chairman Jeff Bredberg, Director of Environmental Services, appeared concerning three requests for monies from the Water Plan. Bredberg stated that the Water Plan Task Force had met and considered three applications for money. The request from the Eagle Lake Association for $1,000.00 for monitoring five stream locations within our watershed to be proactive in monitoring our lake and watershed so they can identify high nutrient areas with the recommendation from the Task Force for $1,000.00. A motion by Shuck 2nd Imdieke to approve the recommendation from the Task Force was on vote unanimously adopted. The request from the Kandiyohi SWCD for $3,000.00 to construct a rain garden and change grasses to natives along with other flowered plants to improve the Ramblewood wetland with the recommendation from the Task Force for $3,000.00. A motion by Madsen 2nd Reese to approve the recommendation from the Task Force was on vote unanimously adopted. The request from the Middle Fork Crow River Watershed District for $3,000.00 to work on the Loon Creek Restoration Project by creating a stable outfall for the stormwater, armoring the outer bends of the channel, removing exotic plant species, and blanketing and seeding the project area to establish deep-rooted native vegetation with the recommendation from the Task Force for $3,000.00. A motion by Imdieke 2nd Reese to approve the recommendation from the Task Force was on vote adopted. Commissioner Shuck abstained from the vote. A motion by Madsen 2nd Shuck to approve the 2014 Recyclable Materials Collection & Transportation License for Shred-It was on vote unanimously adopted. Shelly Eldridge, Senior Financial Advisor from Ehlers & Associates, Inc., appeared regarding the $7,860,000 General Obligation Refunding Bonds, Series 2014A. A motion by Shuck 2nd Butterfield to approve the following Resolution was on vote unanimously adopted. RESOLUTION PROVIDING FOR THE SALE OF $7,860,000 GENERAL OBLIGATION REFUNDING BONDS, SERIES 2014A A. WHEREAS, the Board of Commissioners of Kandiyohi County, Minnesota has heretofore determined that it is necessary and expedient to issue approximately $7,860,000 in General Obligation Refunding Bonds, Series 2014A (the "Bonds"), to refund the County's outstanding Series 2007A and 2004B Bonds for future interest cost savings; and B. WHEREAS, the County has retained Ehlers & Associates, Inc., in Roseville, Minnesota ("Ehlers"), as its independent financial advisor for the Bonds and is therefore authorized to solicit proposals in accordance with Minnesota Statutes, Section 475.60, Subdivision 2(9); NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Kandiyohi County, Minnesota, as follows: 1. Authorization; Findings. The Board of Commissioners hereby authorizes Ehlers to solicit proposals for the sale of the Bonds. 2. Meeting; Proposal Opening. The Board of Commissioners shall meet at approximately 11:00 A.M. on June 3, 2014, for the purpose of considering sealed proposals for and awarding the sale of the Bonds. 3. Official Statement. In connection with said sale, the officers or employees of the County are hereby authorized to cooperate with Ehlers and participate in the preparation of an official statement for the Bonds and to execute and deliver it on behalf of the County upon its completion. The A.I.S. Task Force discussion was tabled until the May 20, 2014 board meeting. A motion by Shuck 2nd Reese to approve the signing of an agreement between Kandiyohi County and Pope County to provide professional intermediate inspector services in Pope County was on vote unanimously adopted. A motion by Imdieke 2nd Butterfield to approve the following Resolution was on vote unanimously adopted. 2014 NOXIOUS WEED APPEALS COMMITTEE RESOLUTION WHEREAS: Minn. Stat. §, 18.83, Subd.3 (2) (2003) requires the Kandiyohi County Board of Commissioners to appoint members of a noxious weeds appeal committee, NOW THEREFORE, Be it hereby resolved by the Kandiyohi County Board of Commissioners that: 1. The "Kandiyohi County Noxious Weeds Appeal Committee" is hereby established. 2. The following are appointed as regular members of the Kandiyohi County Noxious Weeds Appeal Committee: a) Name: Doug Reese 235-6011 Address: 941 Mary Ave SE Willmar, MN 56201 ("County Commissioner or Municipal Official" member) b) Name: Gene Gatewood 995-6247 3 year term Address: 7130 90th Ave SE (2012,2013,2014) Willmar, MN 56201 ("Landowner residing in Kandiyohi County" member) c) Name: Obert Gjerde 264-5732 2 year term Address: 13801 140th St NW (2013,2014) Sunburg, MN 56289 3. The appointment of regular and alternate members is effective immediately and shall continue through December 31, 2014, except for the extended term appointments. 5. The regular members, and the alternate members when called upon to serve, shall be paid their reasonable and necessary expenses incurred while performing their duties as a member of the Kandiyohi County Noxious Weeds Appeal Committee; members, shall receive a per diem of $25.00; $35.00 if over 4 hours; mileage shall be reimbursed at the current IRS rate. ATTEST: BY THE BOARD: Mark Thompson Jim Butterfield County Auditor/Treasurer Chairman Loren Engelby, Kandiyohi County Drainage & Agricultural Inspector, appeared regarding a benefited acres error correction on County Ditch 12 from the Viewers Report approved in June of 2013. Engelby said that it affects two parcels, parcel 33-008-0020 and 33-008-0010. Engelby explained what the current benefits were on these parcels and the proposed corrected benefits for these parcels should be, if approved. A motion by Imdieke 2nd Madsen to approve the proposed benefits for parcels 33-008-0020 and 33-008-0010 as presented was on vote unanimously adopted. Loren Engelby, Kandiyohi County Drainage & Agricultural Inspector, appeared regarding the new EPA proposed rules to describe waters in the U.S. Engelby stated that Rinke Noonan Law Firm had been asked to draft comments to be submitted to the EPA and the Army Corps on behalf of several county drainage authority clients and watershed district clients and by contributing $500.00 to their firm, they would include us in their joint submission of comments. A motion by Imdieke 2nd Butterfield to approve the contribution of $500.00 to be sent to the Rinke Noonan Law firm for joint submission of comments to the EPA and the Army Corps was on vote unanimously adopted.
