Romona and Daryl Kuehn are challenging whether a private ditch built in 1948 on their farm in Yellow Medicine County should be classified as a public waterway and subject to the state's 50-foot buffer requirement. They urged the Yellow Medicine County Board of Commissioners on Tuesday to maintain local responsibility for enforcing the new buffer legislation and not surrender it to the state. Tillage that has occurred right up to the bank of Kandiyohi County ditch compromises the integrity of the sloped bank. The practice contributes to water quality problems by allowing erosion and sloughing to occur, and in the long-run also leads to costly clean out and repair bills for the ditch system. Minnesota has more than 27,000 miles of open ditches, and from the earliest days, as depicted in this old newspaper clipping, they were designed on what might be a flawed premise. The channels were designed only for peak flow events, and not the low water flows that occur through much of the season. That has led to never ending and costly maintenance due to sediment build up.
