Pursuant to action by the Willmar City Council at a meeting held on August 19, 2019, a public hearing will be held on September 3, 2019, at 7:01 p.m., or as soon thereafter as possible, in the Board Room at the Health and Human Services Building located at 2200 23rd Street NE, Willmar, Minnesota.

AN ORDINANCE OF THE CITY OF WILLMAR, MINNESOTA ENACTING A NEW ARTICLE III, FLOODPLAIN MANAGEMENT IN CHAPTER 14 OF THE CITY CODE
Summary: Ordinance No. ___ amends City Code Chapter 14, Land Development, by adding a new Article III (Floodplain Management), pursuant to authority granted to local government units in in Minnesota Statutes Chapter 103F and Chapter 62.
The purpose of this Ordinance is to promote the public health, safety, and general welfare and to minimize those losses in the flood hazard areas of the City. The flood hazard areas of Willmar are subject to periodic inundation which results in potential loss of life, loss of property, health and safety hazards, disruption of commerce and governmental services, extraordinary public expenditures or flood protection and relief, and impairment of the tax base, all of which adversely affect the public health, safety, and general welfare.
This ordinance will apply to all lands within the City located within the Floodway, Flood Fringe, or General Flood Plain districts, all as established in the ordinance and shown on specific floodplain maps adopted in the ordinance and made a part of the City's official zoning map. The ordinance establishes permitted uses, standards for permitted uses, conditional uses, and standards for conditional uses in each of the Floodway and Flood Fringe, districts, standards for all Flood Fringe uses, permitted uses in the General Flood Plain district, and procedures for Floodway and Flood Fringe determination. The ordinance restricts the subdivision of land which creates a lot extending into a delineated flood plain. The ordinance further describes provisions for public utilities, railroads, roads, bridges and regulations for manufactured homes, manufactured home parks and placement of recreational vehicles.
The ordinance contains provisions for its administration and enforcement, including but not limited to permit requirements, variances, conditional uses, hearings, decisions, nonconforming uses and the penalties for violation.
