ADJOURNED MEETING OF THE COUNTY BOARD
IN KANDIYOHI COUNTY

The Board of Commissioners of Kandiyohi County, Minnesota met at 10:00 A.M., July 18, 2006, pursuant to adjournment. All members were present.
A motion by Peterson 2nd Larson to approve the minutes of the July 5, 2006 board meeting was on vote unanimously adopted.
A motion by Madsen 2nd Larson to approve the payment of claims being $227,619.25 from Revenue Fund, $13,314.41 from Regional Treatment Center, $213,331.24 from Road and Bridge Fund, $12,592.77 from County Building Fund, $4,430.00 from Ditch Fund, $1,021.81 from Library Fund, $4,268.52 from Health & Human Services Building Fund, $51,859.16 from Eagle Lake Sewer Fund, $6,497.51 from Water & Sewer Fund, $3,090.00 from Capital Projects Fund, $725.10 from Computer/Communication Maintenance Fund, $32,470.02 from Sanitary Landfill Fund according to the detailed listing of claims as recorded in the office of the County Auditor/Treasurer was on vote unanimously adopted.
A motion by Falk 2nd Larson to approve the Federal Boating Safety Supplement Grant Agreement between the State of Minnesota, acting through its Commissioner of Natural Resources, Bureau of Information and Education and Kandiyohi County, through the Kandiyohi County Sheriff's Department in the amount of $18,385.00, effective July 1, 2006, or the date the State obtains all required signatures under Minnesota Statutes Section 16C.05, subdivision 2, whichever is later and a expiration date of September 15, 2006 or until all obligations have been satisfactorily fulfilled, whichever occurs first was on vote unanimously adopted.
A motion by Madsen 2nd Peterson to approve the donation of a 1994 Crown Victoria car owned by the Kandiyohi County Sheriff's Department to Woodland Centers was on vote unanimously adopted.
Wayne Thompson, County Administrator, appeared regarding the creation of a Human Services Board, which would oversee Family Services, Community Corrections, and Public Health, as outlined in M.S. 2005, Chapter 402. Larry Kleindl from Family Services, Ann Stehn from Public Health and Deb West from Community Corrections gave their pros and cons to adopting this Statute. Commissioner Falk suggested that we review it again in 2 or 3 years. The information was received for information and no action will be taken at this time.
A motion by Larson 2nd Madsen to direct the Planning Commission to study the issue of residential growth patterns in Kandiyohi County with the goal of the Planning Commission to develop specific recommendations about residential development patterns that could translate into a possible amendment to the Comprehensive Plan and the County Zoning Ordinance with the goal of having the study completed by the end of 2006 was on vote unanimously adopted.
A motion by Madsen 2nd Peterson to approve the general obligation note for the "Working Together to Improve Water Quality Project" (Buffalo Creek Watershed) that was approved at the April 4, 2006 board meeting was on vote unanimously adopted.

A motion by Peterson 2nd Larson to approve the renewal of the Kandiyohi County 3.2% Malt Liquor "Off Sale" License for Hak Son, Inc. - Sunray Square for a period beginning August 1, 2006 to April 30, 2007 was on vote unanimously adopted.
A motion by Madsen 2nd Shuck to approve the following Resolution was on vote unanimously adopted.
RESOLUTION
WHEREAS, David D. Jacobson, the former owner has made and filed an application with the County Auditor/Treasurer for the repurchase of the hereinafter described parcel of tax forfeited land, in accordance with the provision of Minnesota Statutes 1945, Section 282.241, of amended, which land is situated in the County of Kandiyohi, Minnesota, and described as follows, to-wit:
That part of the Southwest Quarter of the Northwest Quarter (SW1/4NW1/4) of Section Twenty-five (25), Township One Hundred Eighteen (118) Range Thirty-five (35) described by metes and bounds as follows: Commencing at a point on the West section line of said Section 25 which is 1,195 feet North from the Southwest corner of the Northwest Quarter of said Section Twenty five; thence running East and parallel with the North Boundary line of said Northwest Quarter a distance of 240 feet to the point of beginning, thence continuing to run East and parallel with the North boundary line a distance of 50 feet, thence running North and parallel with the East boundary line of said Northwest Quarter a distance of 81 feet; thence running West and parallel with the North boundary line of said Northwest Quarter a distance of 50 feet; thence running South and parallel with the West boundary line of said Northwest Quarter a distance of 81 feet to the point of beginning.
and WHEREAS, said applicant has set forth in his application that:
The property will be placed on the tax rolls and all delinquent taxes, including all penalties and interest, will be paid in full;
and WHEREAS, this Board is of the opinion that said application should be granted for such reasons,

NOW, THEREFORE BE IT RESOLVED, That the application of David D. Jacobson, for the purchase of the above-described parcel of tax-forfeited land be and the same is hereby granted and the County Auditor/Treasurer is hereby authorized and directed to permit such repurchase according to the provisions of Minnesota Statutes 1945, Section 282.241, as amended.

A motion by Peterson 2nd Madsen to approve the re-zone request of Colleen Caspers to rezone her property in Section 24 of Dovre Township from A-2 General Agricultural District to R-2 Community Residential District with the findings of the Planning Commission was on vote unanimously adopted.
A motion by Falk 2nd Peterson to approve the re-zone request of Douglas Goldschmidt to rezone his property in Section 24 of Dovre Township from A-2 General Agricultural District to CI - Commercial/Industrial District with the findings of the Planning Commission was on vote unanimously adopted.
A motion by Madsen 2nd Larson to approve the Conditional Use Permit for Brian VanEngen, applicant proposing a commercial mini-storage business in an A-1 Agricultural Preservation District on his property in Section 7 of Kandiyohi Township with the findings of the Planning Commission was on vote unanimously adopted.

A motion by Larson 2nd Falk to approve the Conditional Use Permit for Thomas and Riley Gustafson, applicants requesting to construct two additions to existing barns and construct a barn for dairy replacement heifers in an A-1 Agricultural Preservation District on their property in Section 20 of Kandiyohi Township with the findings of the Planning Commission and the following conditions:
1. The owner shall follow all MPCA requirements regarding proper manure management planning, manure application and record keeping
2. Dead animals to be disposed of by rendering, composting, or other methods as approved by the Minnesota Board of Animal Health, and be kept out of sight.

A motion by Madsen 2nd Larson to approve the Conditional Use Permit for Prinsburg Farmers Co-op, applicant proposing an addition to an existing turkey barn, constructing a turkey barn in an A-1 Agricultural Preservation District on their land in Section 14 of Holland Township with the findings of the Planning Commission and the following conditions:
1. Dead animals to be disposed of by rendering, composting, or other methods as approved by the Minnesota Board of Animal Health, and be kept out of sight.
2. The owner shall follow all MPCA requirements regarding proper manure management planning, manure application, and record keeping
3. All manure that is piled outside of the barn for removal at the end of a barn cycle not be stockpiled for any amount of time between the barn and the drainage ditch to the West

Leroy Dahlke presented to the Board a draft management plan for Wakanda Lake. There was discussion from the Board and people in the audience regarding the plan. The report was received for information.

Gary Danielson, Public Works Director, appeared regarding the bids for SP 34-610-14 and SAP 34-599-30 (County Road #10 reconstruction) and recommended that the bid be awarded to the lowest bidder, Duininck Bros., Inc. of Prinsburg, MN in the amount of $2,942,346.17. A motion by Madsen 2nd Larson to award the bid for SP 34-610-14 and SAP 34-599-30 (County Road #10 reconstruction) to the lowest bidder, Duininck Bros., Inc. of Prinsburg, MN in the amount of $2,942,346.17 was on vote unanimously adopted.
On motion the meeting was adjourned until 10:00 A.M., August 1, 2006.
