n A felony charge of third-degree criminal sexual conduct against Leo Lovell Brumfield, 20, of Willmar, was ordered to be continued for dismissal on Monday.

Judge Kathryn N. Smith ordered that the charge be dismissed in one year if Brumfield remains law abiding.

The charge was filed after Willmar police were informed on Jan. 9 by Kandiyohi County Family Services that a female juvenile, now 16, had given birth to a child on Oct. 13, one day after her 16th birthday. The father was identified as Brumfield. The girl confirmed the information in an interview with detectives. She said Brumfield knew she was 15 because her mother told him so. She also said she agreed to have sex with him and that no force was used.

When interviewed by detectives, Brumfield confirmed that he had dated the girl since January 2007 and that they had sex at a family member's home in Willmar.

As part of a plea agreement, two felony charges for domestic assault by strangulation and terroristic threats and another misdemeanor for domestic assault will be dismissed.

The charges were filed after Willmar police were called around 4 p.m. March 22 to respond to a domestic incident at a home on the city's southwest side. A woman there said Albrecht had come over to the home on Friday evening and talked with her about his treatment options for drug abuse. An argument followed, and he went into the bathroom to shoot up. She said he swore at her, threatened to slit her throat and then choked her by twisting the hood of her hooded sweatshirt so that she could not breathe or talk. The woman also said she locked her children into a bedroom and went after Albrecht, who forced his way back into the home and grabbed her by the throat. A child at the scene said she saw Albrecht's hand on the woman's throat and that he had said bad words.

Albrecht was arrested and taken to the county jail. He told officers they had talked about treatment options and that the woman had "got an attitude" early in the conversation and was verbally abusive to him. He denied the physical involvement or threats and denied the drug use. The officer observed red marks on his arms consistent with intravenous drug use. Another woman told officers she had gone to pick Albrecht up at the home and that he was under the influence of something at the time. She also said he has struggled with and addiction to pain killers.

Albrecht will be sentenced Oct. 2.
