As a condition of the stayed sentence, he was ordered to serve 125 days in the county jail, with credit for 95 days already served, to complete a chemical dependency evaluation, attend a property-crime impact panel and write an apology letter.

Onstad was charged with third-degree burglary after Willmar police officers were called around midnight on April 17, 2007, to the Subway restaurant along First Street South in response to an alarm for unauthorized entry. They found the back door unlocked and entered the building but didn't find anyone inside. A keyholder responded and told them that an employee, Onstad, had recently been released from his employment. Onstad still had keys to the building, but the alarm code had been changed. Officers reviewed surveillance video that revealed that Onstad entered, checked for money in two cash registers and a safe and then exited through the rear of the building.

- Daniel Loera, 23, of Willmar, was sentenced Thursday to a year and a day in jail, which was stayed, a $1,500 fine and five years of probation on a felony charge of theft - liability for crimes of another for stealing tools and a construction trailer from contractors in Willmar and rural Spicer.

As part of a plea agreement, five additional felony charges were dismissed. Loera was ordered to pay $795 in restitution to one of the contractors, with the matter of restitution remaining open for the rest of the victims. He was ordered to serve 120 days in jail, with credit for seven days served, have no association with criminal gangs, attend a property-crime impact panel and victim-offender mediation.

The charges were filed against Loera and Jose Reyna-Lozano, 26, of Willmar, in December after a police investigation that began when officers were called to the Days Inn around 6 a.m. Dec. 8 by a communications contractor staying at the hotel. The man had found his truck's door open and more than $4,500 worth of tools and equipment missing from the vehicle.

Police had attempted to stop a vehicle around 4 a.m. that morning near Gorton Avenue. The officer was able to catch one of the three men who ran away during the traffic stop. He was later identified as Reyna-Lozano. Police later searched the vehicle and found several of the missing items.

The amended complaint added four additional felony theft charges for taking a construction trailer and tools from a rural Spicer location.

According to the complaint, officers were called around 7:30 a.m. Dec. 7 to a Spicer address south of Elkhorn Lake on 71st Street Northeast. A construction trailer was missing and tracks in the snow showed that someone had pulled it away. Some of the contents of the trailer were on the ground. Tools, valued around $2,600, were missing. The trailer, valued at $1,500, was later found at a Spicer location. While police were inventorying the vehicle, they discovered tools that were later identified by the contractor/owner.

Officers took photos of the footprints and tire tracks at the scene and they matched the tires on the car from which Loera and Reyna-Lozano allegedly fled and the shoes they were wearing when arrested.

Reyna-Lozano, 26, of Willmar, was sentenced May 8 to 10 years of probation, $1,000 in fines and 120 days in jail for receiving stolen property in connection with the thefts. He was also ordered to pay $795 in restitution.
