Kerkhoven man enters plea to lesser charges in sexual assault case

WILLMAR -- Juanel Anthony Mikulak, 20, of Kerkhoven, pleaded guilty Monday to two gross misdemeanor charges for fifth-degree criminal sexual conduct for having a sexual relationship with a 15-year-old girl, and for sexually assaulting another 15-year-old on prom night.

As part of a plea agreement entered in Kandiyohi County District Court, three felony charges of criminal sexual conduct were dismissed. He will be sentenced on Dec. 8.

The charges were filed after the Willmar Po-lice De-partment's high school resource of-ficer re-ceived a report on May 6 that two 15-year-old girls had sexual contact with Mikulak. One of the girls reported being sexually assaulted on May 2 and the other that she was dating Mikulak.

The first girl, in an interview with police, said she and the other 15-year-old, hung out at Mikulak's apartment in downtown Willmar and at other locations around town. She said he asked her to come over to the apartment and hang out around 11 p.m. after he attended the Willmar High prom with a third girl. She said he forced himself on her and had sex with her.

The second girl said she had been dating Mikulak for six to seven months and was having sex with him for two months. She said he knew she was 15 years old. The officer was contacted by a family member, who said they were quite certain the girl was having sex with Mikulak.

On May 14, a detective interviewed Mikulak at the Meeker County Jail, where he was serving time on an unrelated charge. He admitted to having a relationship and sex with the second girl, but said that she seduced him. He also said he thought she was 17 years old.

He admitted to knowing the first girl, but denied anything happened.

Further investigation of the phone logs from the Meeker County Jail revealed that Mikulak had a conversation with someone about the rape charges, during which he admitted to lying to the investigator and also admitted to dealing marijuana.
