* An Ortonville man was arraigned Monday on four counts of first-degree driving while impaired and one count of open bottle.

Jerry Dean Austin, 49, was arrested late Friday night in Atwater after an Atwater police officer, who was on routine patrol, observed a vehicle moving erratically and crossing the center line and fog lines at least four times, with oncoming traffic.

Court records said Austin failed a field sobriety test. Two open cans of beer also were found in his vehicle.

A check of his driving license found he had four prior revocations for alcohol-related offenses, the most recent one resulting in a felony conviction for driving while impaired.

Spilseth set the terms of Austin's conditional release at $3,000 cash or bond. Austin also was placed on electronic home monitoring and ordered to report immediately to probation.

His next court appearance is a hearing set for Aug. 25.

Judge Donald Spilseth agreed to release Heald on his own recognizance, but required him to submit to home electronic monitoring and report immediately to probation. Unconditional release was set at $12,000 cash or bond.

A Kandiyohi County sheriff's deputy, who was dispatched to the scene, reported having to knock several times on the window before the driver, later identified as Heald, responded.

According to court records, a check of Heald's driver's license revealed that it had been canceled. Heald also failed a field sobriety test.

He is scheduled to appear again in court for a hearing on Aug. 25.

Cody Lyle Lawrence Jackson, 18, appeared Monday before Judge Donald Spilseth, who allowed him to be released conditionally. Terms of the release were set at $5,000 cash or bond.

The victim, along with several witnesses, told law enforcement officials that Jackson became involved in a fight at an Atwater home. After the fight broke up, the victim allegedly was handing Jackson his sandals when Jackson punched him in the jaw, breaking it in two places.

* A 19-year-old Willmar man was arraigned Monday for allegedly having sex with an underage girl in Willmar last month.

Augustine Sanchez is charged with criminal sexual conduct in the third and fourth degrees.

Judge Donald Spilseth set his unconditional release at $75,000 cash or bond. Terms of conditional release include $5,000 cash or bond, and having no contact with the alleged victims or with any young women under age 18 without supervision.

Willmar police learned of the incident when the two victims, one 15 years old and the other just shy of 16, were brought to a medical clinic by their parents/ guardians on the evening of July 15. The girls had run away the day before.

The girls told an investigator they had gone to a house on Olena Avenue to hang out. At some point during the evening, one of them allegedly went into one of the bedrooms and had sex with Sanchez. The other girl also allegedly had sex with a second suspect, whom she knew as "Shorty" and who was later identified as Sanchez's cousin, Emmanuel Briones.

The girls told Willmar police they stayed at the house until 6:30 a.m. the next day, when Shorty walked them home. They later identified both men in a photo lineup.

According to court records, Sanchez told police the sex was consensual and that he thought the girl was 18. Briones has not been located.
