Charges were filed against Leiva-Pineda after a July 9 incident when he and another man allegedly cut two other men during a fight along the 300 block of Robert Street Southeast.

According to the complaint, a Willmar police officer responded to a large fight around 2:42 a.m. July 9. The fight allegedly broke out between two groups of men and women along Robert Street. According to witness statements, Alberto Turrubiates, 28, of Willmar allegedly stabbed a man several times during the fight. Another witness reported seeing Leiva-Pineda allegedly cut another man during the fight.

Turrubiates was interviewed by authorities later. According to the complaint, Turrubiates said Leiva-Pineda allegedly had a butterfly knife and cut a man during the fight. Turrubiates denied ever having the knife during the fight.

Turrubiates appeared in court Dec. 11 on the same three felony charges Leiva-Pineda is facing -- two counts of second-degree assault and one charge of second-degree riot.

Leiva-Pineda was arrested after a Dec. 2 traffic stop by a Willmar police officer. Leiva-Pineda had a warrant for his arrest from the July incident. While booking Leiva-Pineda into jail, 1 gram of cocaine was found in his wallet, according to a another complaint.

Leiva-Pineda faces another felony charge for the controlled substance violation resulting from the December traffic stop. The controlled substance violation is separate from the assault and riot charges against Leiva-Pineda.

* A 19-year-old Willmar man was sentenced Thursday on a controlled substance violation stemming from an investigation in March.

Jordan Lee Albu was charged with a fifth-degree felony controlled substance violation after an informant for the CEE-VI Drug Task Force was able to purchase 28.8 grams of marijuana from Albu. Albu pleaded guilty to the charge under the agreement he would receive a stay of adjudication at sentencing.

A stay of adjudication would leave Albu without a record of the charge if he complies with the probation conditions set at sentencing.

On Thursday, Judge David L. Mennis stayed adjudication of the sentence for five years and fined Albu $1,000. As a condition of the stay of adjudication, Mennis ordered Albu to serve 45 days in jail. Albu will be released from jail Jan. 8 if he is enrolled in school and may also serve the remaining time during breaks from school or in the summer.

Charges were filed against Albu after a March 22 controlled drug purchase by CEE-VI agents and a controlled informant.

According to the complaint, the informant made arrangements to purchase an ounce of marijuana from Albu. The informant was able to buy the marijuana from Albu on the sixth floor of the Lakeview Apartments.
