Graffiti
WILLMAR - Graffiti was reported around 8 p.m. Wednesday at Miller Park, 1105 Kandiyohi Ave. S.W.
WILLMAR - Graffiti on the walking bridge was reported around 10:50 p.m. Wednesday along the 100 block of Gay Street Northeast.
WILLMAR - Graffiti on a bridge pillar was reported around 9:25 a.m. Thursday near the intersection of Second Street and Benson Avenue.
Theft
NEW LONDON - The theft of a laptop was reported around 7:40 p.m. Wednesday along the 25000 block of 12th Street Northwest.
Burglary
WILLMAR - A burglary was reported around 11:30 a.m. Thursday along the 1300 block of Lakeland Drive Northeast.
Arrests
ATWATER - A 34-year-old man was arrested on charges of driving while impaired around 1:30 a.m. Thursday along the 20000 block of Highway 12 East.
HAWICK - A 49-year-old man was arrested on charges of domestic assault around 10 a.m. Thursday along the 22000 block of 141st Street Northeast.
District Court
Kandiyohi County
* Roberto Zamora Jr., 31, of Clara City, was sentenced Wednesday to 21 months in prison and a $500 fine on a third-degree drug possession charge in a case that dates back to 2002.
However, Zamora was given credit for four years and 56 days already served in custody. He will be allowed to do community service work to pay the fine.
As part of a plea agreement, the charge was reduced from second-degree level and five additional charges for open bottle, no insurance, underage drinking and driving, no Minnesota driver’s license, and giving a false name to a peace officer were dismissed.
In August 2002, Zamora, 20 years old at the time, was charged with a second-degree controlled substance crime and the lesser counts. An arrest warrant for Zamora was issued after he failed to appear at an Oct. 4, 2002, hearing.
Zamora has apparently had some contact with the courts over the years.
According to court records, in August 2004, Zamora sent a handwritten letter to Kandiyohi County courts asking to file a federal motion for a speedy trial. He said in the letter that he was incarcerated in Texas.
The court responded that he had made a request under federal statutes for a case filed in state courts. The court administrator’s office at the time mailed him a copy of state statutes that might apply and recommended he consult an attorney.
In June 2006, Zamora sent a handwritten letter to Judge Donald Spilseth asking to be sentenced to his time served to settle the criminal case. Zamora apologized for violating the law while he had a drug problem and said he had been rehabilitated. He wrote that he had fled the state because he was afraid of being incarcerated away from his family. He was in the state as a migrant worker, he wrote.
Also in June 2006, the Kandiyohi County attorney’s office responded that Zamora needed to return to face the charges, as the second-degree drug charge carries mandatory prison time.
Spilseth wrote to Zamora in early July 2006 that he couldn’t handle the case in that way and urged him to contact a lawyer.
* Scott Lee Trevino, 18, of Pennock, was sentenced to 7½ years of probation and 100 hours of community work service on a third-degree criminal sexual conduct charge for having sex with a 14-year-old girl.
Another third-degree count was dismissed. Trevino received a stay of adjudication on his sentence. Under the stay, no conviction will appear on his record if he complies with the conditions of probation.
The charges were filed after Willmar police were called on Oct. 18 by a person who said they had confronted Trevino about his sexual relationship with the girl.
Trevino was interviewed and admitted to having sex with the girl on two occasions in Willmar. He also allegedly admitted that he knew the girl was 14 years old and that sex with her was illegal. The age of legal consent in the state is 16 years old.
The girl was also interviewed and confirmed that she had relations with Trevino.
