WILLMAR - Tweets sent to an Atwater teenager have led to five felony counts of violating a domestic no-contact order for an Osakis man.
Todd Hendricks, 46, was arrested on a warrant this week in Willmar and made a first appearance Friday on the criminal charges.
According to court documents, the domestic abuse no-contact order was issued in August 2013, barring Hendricks from having any contact with an Atwater woman and her three children, ages 18, 14 and 9. The order included a provision that Hendricks could respond to the children if they initiated the contact - but he was not allowed to initiate the contact himself.
Authorities were notified late last year that Hendricks allegedly used Twitter to start a conversation with one of the children on five separate occasions in September, October and November.
Judge Donald Spilseth set unconditional bail at $15,000 on Friday or conditional cash release at $1,000. The next court appearance for Hendricks is scheduled for Jan. 20.
Hendricks has prior convictions in 2012 and 2013 for violating a domestic abuse no-contact order, according to the court record.
WILLMAR - Judge Donald Spilseth on Thursday sentenced Matthew Preston Albert, 38, address unknown, to 18 months at the Minnesota Correctional Facility in St. Cloud. The sentence was stayed for five years and Albert was given credit for serving 67 days.
Albert had pleaded guilty Dec. 1 to a felony count of violating a no contact order within 10 years of the first of two or more convictions. A second felony charge of violating a no contact order within 10 years of the first of two or more convictions was dismissed. Albert was placed on supervised probation for five years, was ordered to pay $1,090 in fine, fees and surcharge, and may perform community service work for the fines.
WILLMAR - Robert Charles Johnson, 51, of Willmar pleaded guilty Wednesday to one felony count of take/use/transfer movable property-no consent in connection with overstating income tax withholding and receiving an excess of $15,000. Sentencing is set for Feb. 18 before Judge Donald Spilseth.
In a petition to enter the guilty plea, Johnson agreed to plead to one felony count; participate in an audit conducted by the Minnesota Department of Revenue for the years 2009, 2010, 2011, 2012 and 2013; and pay taxes, interest and penalties determined following such audit.
Johnson and his wife, Kristine Marie Johnson, 52, had faced four counts of false or fraudulent tax returns, four counts of failure to pay or collect taxes and four counts of theft.
The petition signed by Robert Johnson stated that Johnson’s attorney and the prosecuting attorney agreed that if Johnson entered a plea of guilty, the prosecutor will dismiss all remaining counts, dismiss the complaint pending against Kristine Marie Johnson, and will abstain from advocating for incarceration.
According to the criminal complaint drafted by the Minnesota Department of Revenue, the husband and wife jointly claimed an additional $5,412 of Minnesota Individual Income Tax withholding, which allowed the couple to receive refunds of $3,786 greater than for what they were entitled to each year between 2009-12.
Minnesota Department of Revenue auditors examined the couple’s income tax returns and found that the couple has additional outstanding income tax debt of $9,114, including tax, penalty and interest.
