WILLMAR -- Rosny Yovany Dubon, 22, of Willmar, received a stayed sentence of 36 months in prison and 10 years of probation for having sexual intercourse with a 14-year-old Willmar girl last summer.
As part of the sentence handed down Monday by Judge Donald M. Spilseth in Kandiyohi County District Court, Dubon was ordered to register as a predatory offender, complete a psycho-sexual evaluation and have no contact with the victim or any other minor female without permission. As a condition of the stayed sentence, he was ordered to serve 196 days in jail, but given credit for 196 days already served.
Dubon was convicted on Jan. 4 of third-degree criminal sexual conduct after a two-day jury trial. He was charged with the crime after the girl reported that she and Dubon had sex at his home after meeting at a football game on June 9 in Willmar.
The girl told police his name was "Carlos" be-cause he had the name tattooed on his neck. The victim later picked him out of a police phone line-up.
The girl's mother provided a victim impact statement, read by First Assistant County Attorney Connie Crowell during the sentencing. The woman asked for punishment for Dubon, but also requested that he gets the help he needs. The incident has driven the family to move away from Willmar, the statement said.

"They don't feel safe here," Crowell said. "They will move from the community."
However, it is not likely that Dubon will stay in the community. Crowell noted that it was her understanding that agents from the Bureau of Immigration and Customs Enforcement will take Dubon into custody within 72 hours of his sentencing.
